1. Data Controller

Kyle Abent d/b/a SongCreatorVision ("we", "us", "our") is the data controller for personal data collected through GuitarSesh and songcreatorvision.com.

2. What We Collect

2.1 Local Data (Stored on Your Device Only)

GuitarSesh stores the following data locally on your computer. This data is never transmitted to our servers:

  • Gameplay statistics, scores, and progress
  • User settings and preferences
  • Song library metadata
  • Career mode progress
  • Audio calibration data

2.2 Data Transmitted to Our Servers (With Your Consent)

The following data is collected only when you voluntarily use the Feedback or Community Polls features, and only after you have reviewed and accepted the in-app data sharing consent prompt:

  • Steam ID – used to prevent duplicate poll votes and enforce submission rate limits (3 per hour)
  • Platform – your operating system (Windows, macOS, or Linux), used to diagnose platform-specific bugs
  • App version – the build you are running, used to identify version-specific issues
  • Free-text content – the feedback subject, message, or poll vote you submit
  • IP address – automatically recorded by our server when it receives your request
  • Timestamp – the date and time of your submission

2.3 Website Data

When you visit songcreatorvision.com or create an account, standard web server logs (IP address, browser type, pages visited) may be recorded. Account registration collects an email address used solely for authentication.

3. How We Use Your Data

Data collected under Section 2.2 is used exclusively for:

  • Fixing bugs and diagnosing technical issues
  • Understanding player needs and priorities
  • Improving the software based on community feedback
  • Preventing abuse (rate limiting, duplicate vote prevention)

We do not sell, share, rent, or trade your personal data with any third party. We do not use your data for advertising, profiling, or marketing purposes.

4. Legal Basis for Processing (GDPR)

For users in the European Economic Area (EEA), United Kingdom, and Switzerland, we process your data under the following legal bases:

  • Consent (Article 6(1)(a) GDPR) – for Feedback and Community Poll submissions. You provide explicit consent via the in-app prompt before your first submission.
  • Legitimate interest (Article 6(1)(f) GDPR) – for standard web server logs necessary for security and abuse prevention.

5. Consent and Withdrawal

Before using the Feedback or Community Polls features for the first time, you will be shown a consent prompt explaining what data is collected and why. You must actively check a checkbox and click Accept to proceed.

You may withdraw your consent at any time by:

  • Toggling off "Data Sharing" in the Settings screen within GuitarSesh
  • Contacting us at [email protected]

Withdrawing consent disables the Feedback and Community Polls features but does not affect any other functionality of the Software.

6. Data Storage and Security

Submitted feedback and poll data is stored on servers located in the United States. Data is stored in a database accessible only to the developer. We use HTTPS encryption for all data in transit.

By consenting to data submission, you also consent to the transfer of your data to the United States, where data protection laws may differ from those in your country.

7. Data Retention

Feedback and poll data is retained until you request deletion. You may request deletion at any time by contacting [email protected] (see Section 9).

8. Third-Party Services

GuitarSesh is distributed through Steam (Valve Corporation). Your Steam account and purchase data are governed by Steam's Privacy Policy. We do not have access to your Steam purchase or payment information.

9. Your Rights

Depending on your jurisdiction, you may have the following rights regarding your personal data:

  • Access – request a copy of the data we hold about you
  • Rectification – request correction of inaccurate data
  • Erasure – request deletion of your data
  • Restriction – request that we limit processing of your data
  • Portability – request your data in a machine-readable format
  • Objection – object to processing based on legitimate interest
  • Withdraw consent – at any time, without affecting the lawfulness of prior processing

If you are in the EEA, you also have the right to lodge a complaint with your local data protection supervisory authority.

California residents: We do not sell or share personal information as defined by the California Consumer Privacy Act (CCPA/CPRA). You have the right to know what personal information we collect, to request its deletion, and to opt out of any future sale or sharing (though we do not engage in either).

10. Children's Privacy

GuitarSesh is not directed at children under 13. We do not knowingly collect personal data from anyone under the age of 13 (or the applicable age of digital consent in your jurisdiction). If you believe we have collected data from a child, please contact us and we will promptly delete it.

11. Changes to This Policy

We may update this Privacy Policy from time to time. Material changes will be communicated via the Software or this page. The "Last updated" date at the top indicates when the policy was last revised. Continued use of the Feedback or Community Polls features after an update constitutes acceptance of the revised policy.
